Terms of Service & Refund Policy

These terms cover website design and related services from Berger Web Co ("I", "me") for you, the client. Each project also gets a written quote; if the quote and these terms disagree, the quote wins.

1. Quotes and the free mockup

Prices on this site and from the instant quote tool are estimates. I confirm the final price with you in writing before any paid work starts. The first mockup is free, and you're under no obligation to buy.

2. Payment

• One-time projects: 50% when you approve the mockup, 50% when the site goes live, unless your written quote says otherwise.
• Accepted: card, Zelle or Venmo.
• Costs paid to other companies are separate and paid by you, such as your domain name (usually about $12/year) or any paid tools you choose. I'll tell you about any of these before you're charged.
• Rush delivery, if you ask for it, adds 25% as shown in your quote.
• Flagship projects may use a different payment schedule, set out in the written quote.

3. Refunds

• Mockup: free, so nothing to refund.
• Before design work begins: full refund of your deposit.
• After work has begun but before launch: you can cancel anytime. I'll refund the part of your deposit that covers work not yet done.
• After launch: the final payment isn't refundable, but I'll fix anything that doesn't match what we agreed on, at no charge, for 30 days.
• Monthly services: cancel anytime. Cancelling stops the next charge; the current month isn't prorated. Ad spend already paid to Google or Meta is controlled by those platforms, not by me.

4. Changes and revisions

Each package includes the rounds of revisions listed in your quote. Changes after launch that aren't covered by a monthly plan are billed at $125/hour, quoted in advance.

5. Your content

You're responsible for having the rights to the text, logos and photos you give me. Photos I supply come from licensed or free-to-use sources.

6. Ownership

Once paid in full, you own your website's content and design, and your domain is registered in your name. If you leave, I'll hand over your files. Open-source code and tools used to build the site stay under their own licenses.

7. Monthly plans

• Storefront plan ($149/month): hosting, security, daily backups, up to 1 hour of changes, Google Business Profile posts and photo updates, and a monthly report.
• Showcase plan ($299/month): everything in the Storefront plan, plus up to 3 hours of changes, automatic review requests, 2 new local search pages per month, call tracking and a quarterly strategy call.
• Flagship plan ($899/month + ad spend): everything in the Showcase plan, plus management of your Google and Meta ad campaigns, A/B tested landing pages, weekly reports and priority support. Ad spend is paid by you directly to Google and Meta and is separate from my fee.
• Unused update hours don't roll over. Plans renew automatically every month until you cancel. Cancel anytime by text, call or email before your next billing date; the current month isn’t prorated.

Without a monthly plan, I can set the site up on a hosting account in your name.

8. Results

I build sites to be fast, work well on phones and be set up for search engines, and I manage ads to get you calls and bookings, but I can't guarantee rankings, traffic, leads or sales, since those depend on things outside my control, like Google, Meta and your market.

9. Liability

To the extent the law allows, my total liability for any claim is limited to the amount you paid me for the project in question.

10. Governing law

These terms are governed by the laws of the State of Florida.
